Terms and Conditions Governing Authorized Users' Internet Access to the Work Integrated Learning Community Support and Research Portal

By using this online Work Integrated Learning Community Support and Research Portal ("Portal"), you agree to these Terms and Conditions Governing Authorized Users' Internet Access to the Content of the Portal (“Terms and Conditions of Use”), which may be subject to an agreement entered into between Cooperative Education & Internship Association for access to the Journal of Cooperative Education & Internships (“Journal”) and the Member Institution. If you have questions about the Member Institution’s Electronic Journal and Database License Agreement with the Cooperative Education & Internship Association, please contact your institutional library.
From time to time, the Member Institution may amend these Terms and Conditions, in consultation with the Journal, and will post any changes on this website. It is the responsibility of the Authorized User to review these Terms and Conditions prior to accessing this Journal and thereafter to regularly review any changes.

The following definitions are used in this agreement:

Authorized User(s) and the Member Institution agree to the following Terms and Conditions of Use:

1. General Terms of Use This website contains material which is licensed to the Member Institution. This material includes, but is not limited to, content, the design, layout, look, appearance and graphics. The files available for download from this website may be used in accordance to these terms:

1.1 Display. Member Institution and Authorized Users shall have the right to electronically display the Licensed Materials.

1.2 Digitally Copy. Member Institution and Authorized Users may download and digitally copy, in whole or in part, the Licensed Materials.

1.3 Print Copy. Member Institution and Authorized Users may print, in whole or in part, the Licensed Materials.

1.4 Saving Copy. Member Institution and Authorized Users may electronically save, in whole or in part, the Licensed Materials.

1.5 Recovery of Copying Costs. Member Institution may charge a fee to Authorized Users or others to cover costs of printing, in whole or in part, the Licensed Materials for Authorized Users, including the costs associated with reproducing portions of the Licensed Materials for the creation of Print Course Packs. Such fees shall not constitute Commercial Use.

1.6 Print Course Packs/Electronic Reserve. Member Institution and Authorized Users may incorporate, in whole or in part, the Licensed Materials in Print Course Packs and Electronic Reserve collections for the use of Authorized Users in the course of instruction at a Member Institution, but not for Commercial Use. Each such item shall carry appropriate attribution of the source, as per the Creative Commons License under Section 2 and 4 in these Terms and Conditions of Use. Print Course Packs in non-electronic non-print perceptible form, such as audio or Braille, may also be offered to Authorized Users who, in the reasonable opinion of the Member Institution, have a visual, perceptual, or physical disability.

1.7 Electronic Learning Environments. Member Institution and Authorized Users may incorporate reasonable portions of or links to the Licensed Materials to be used in virtual or managed environments (e.g. course management systems). Each such item shall carry appropriate attribution of the source.

1.8 Use in Academic Research. Member Institution and Authorized Users may incorporate reasonable portions of the Licensed Material in printed or electronic form in assignments, portfolios, theses and dissertations, including reproductions of portions of the Licensed Material for deposit in institutional repositories and other non-Commercial Uses.

1.9 Electronic Links. Licensor agrees to use reasonable efforts to comply with the OpenURL standard. Member Institution may provide electronic links to the Licensed Materials from Member Institution’s web pages and is encouraged to do so in ways that will increase the usefulness of the Licensed Materials to Authorized Users. Licensor will assist Member Institution in creating such links effectively, and will use the OpenURL standard for such links whenever feasible. Licensee may make changes in the appearance of such links or statements accompanying such links as reasonably requested by Licensor.

1.10 Scholarly Sharing. Member Institution and Authorized Users may transmit to a third party colleague in hard copy or electronically, reasonable amounts of the Licensed Materials for personal use or scholarly, educational, or scientific research or professional use but in no case for Commercial Uses. In addition, Authorized Users have the right to use, with appropriate credit, figures, tables and excerpts from the Licensed Materials in Authorized User own scientific, scholarly and educational works.

1.11 Training Materials. Member Institution and Authorized Users may display, download or print the Licensed Materials for the purpose of internal marketing, testing or training Authorized Users or groups of Authorized Users.

1.12 Marketing Materials. Member Institution and Authorized Users may display, download or print training and promotional materials related to the Licensed Materials for the purpose of internal marketing or for training Authorized Users or groups of Authorized Users.

1.13 Persons with Visual, Perceptual or Physical Disabilities. Licensed Materials must be provided in an Accessible Format. Without limiting the previous sentence, in the event that any Licensed Materials are not in Accessible Format, the Member Institution shall have the right to modify the format or copy the Licensed Materials, for legal compliance, provided that the content itself is unaltered, in order to make it useable to Authorized Users within the scope of this Agreement.

2. Disclosure of Personal Information

Access to some portions of the Portal is subject to registration and authentication. Authorized Users will disclose personal information as a part of the membership registration process. Anonymized data will be collected and used for marketing and researching

2.1 Use of Personal Information The personal information provided by Authorized Users will be used exclusively for the purposes of internal reporting, improvements to the website, and producing anonymous statistics for marketing. Personal information of Authorized Users will not be disclosed to any person or body outside of the University of Waterloo or their agents.

2.2 Handling of Personal Information Personal information will be stored on a secure server and is subject to security and access controls, including username, password authentication and data encryption, where appropriate.

3. Copyright

Reproduction of the content of the Portal and the Licensed Materials is prohibited other than in accordance with the copyright notice, which forms part of these Terms and Conditions of Use. Permissible distribution shall acknowledge the copyright owners. Authorized Users are permitted to reproduce or disseminate Journal content including citation information, abstracts, and descriptors may be reused within the parameters of the Creative Commons CC BY-NC 4.0 license: https://creativecommons.org/licenses/by-nc/4.0/.

4 Accessibility

The Member Institution is committed to Accessible Formats and the Member Institution is making every effort to ensure all content hosted on its’ site is accessible. Due to the volume of material some Licensed Material may not yet be converted. If accommodation is required for particular resources, contact the site administrators through the feedback form and those resources will be prioritized.

5. Restrictions

5.1 Commercial Redistribution The content of the Portal and Licensed Materials are not to be used commercially or redistributed for commercial purposes and that any and all distribution shall acknowledge the copyright owner(s). No commercial re-use (such as, downloading, posting of a file, and printing to sell or distribute to any non-Authorized User) of any Journal content is permitted. 5.2 Removal of Copyright Notice All Authorized Users agree not to remove, cover, overlay, obscure, block, or change any copyright notices, legends, or terms of use.

6. Privacy Policy

Use of the Journal indicates acceptance of the Member Institution’s Privacy Policy, available at: https://uwaterloo.ca/privacy/privacy-statement as it may be amended from time to time.

7. Authentication

The Member Institution shall make reasonable efforts to create and maintain appropriate security measures to ensure that only Authorized Users can access some parts of the secure site. The Member Institution shall ensure that articles will be available to the public without requiring authentication. The Member Institution shall use all reasonable methods to inform Authorized Users of these Terms and Conditions.

7.1 IP Addresses The Member Institution affirms that all Internet Protocol ("IP") addresses provided for use of online Journal are controlled by the Member Institution exclusively for Internet Access by Authorized Users.

7.2 Abuse The Member Institution reserves the right to suspend or terminate membership of Authorized Users. Reasons for possible suspension of termination include, but are not limited to, submission of resources in violation of copyright agreements, abuse or misuse of community forums, and use of resource information in violation of Creative Commons Legal Code: Attribution-Non Commercial 4.0 International – CC BY-NC 4.0. If any Authorized Users become aware of unauthorized access to the Journal, they shall notify the Member Institution immediately and cooperate in locating and attempting to stop the specific individual(s) who is abusing the service. If the specific abuser(s) cannot be identified or stopped, the Member Institution has the right to withhold, suspend, or terminate access to any or all Journal content, without incurring any liability. The Member Institution reserves the right to remove any content from the site, including resources and community forum posts, for any reason and without notice as a result of breach of copyright agreements and complaints related to the content by other members.

8. Technical Access

The Member Institution intends for the Journal web site to be available 24 hours per day, 7 days per week. However, the Member Institution will not be liable for damages should a site become unavailable temporarily or access to a site becomes slow or incomplete due to system back-up procedures, Internet traffic volume, upgrades, overload of requests to the servers, general network failures or delays, or any other cause which may from time to time make Journal content inaccessible to Authorized Users. The Member Institution will make reasonable efforts to notify Authorized Users of any unusually extended interruptions and will attempt to restore access to the site as soon as possible.

9. Representations and Warranties

This website may contain links to third-party web sites or services. The Member Institution has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. The Member Institution affirms that it has obtained any and all necessary permissions to license Journal content, and that the use of such content by Authorized Users in accordance with these Terms and Conditions of Use shall not infringe the copyright of any third party. While the Member Institution seeks to ensure the accuracy of Journal content posted online, the Member Institution does not warrant or guarantee its accuracy, completeness, merchantability, or fitness for a particular purpose.

10. Limits of Liability

Authorized Users are responsible for verifying that any resources they submit are not in violation of copyright agreements and are liable in the event of a complaint. While the Member Institution will make efforts to avoid breach of copyright and to remove resources that are in violation of copyright agreements, the Member Institution will not be held liable for submissions that violate the Creative Commons CC BY-NC 4.0 license: https://creativecommons.org/licenses/by-nc/4.0/. Neither the Member Institution nor Cooperative Education & Internship Association shall be liable for any indirect, special, incidental, punitive or consequential damages, including but not limited to loss or breach of data, business interruption, personal harm or injury, or loss of profits, arising out of the use of or the inability to use the Journal content.

11. Severability

If any of these Terms and Conditions of Use is found to be invalid, illegal, under dispute, unenforceable or in conflict with the law of any jurisdiction, the remaining Terms and Conditions of Use shall remain in full force and effect.

12. Disputes

In the event of any dispute or controversy arising out of or relating to these Terms and Conditions, the Member Institution and the Cooperative Education & Internship Association agree to exercise their best efforts to resolve the dispute as soon as possible. If, despite best efforts, a dispute cannot be resolved by mutual agreement, it will be subject to mediation or binding arbitration. Both parties shall, without delay, continue to perform their respective obligations that are not affected by the dispute.
